Custom Cupcake Order Agreement
Thank you for choosing Sugar Crumbs Bakery for your custom cupcake needs. Please read this contract carefully. By signing below, you agree to the terms outlined herein. If you have any questions, please message me before signing.
Design
The provided sketch(s) (if one is given) or inspiration photo is a rough example only. The final cupcakes may vary slightly in appearance, including the placement of elements. I reserve the right to take creative liberty to ensure the best possible outcome. If a specific color match has been requested, I will make every effort to match it as closely as possible, but an identical match cannot be guaranteed due to variations in ingredients, lighting, and other factors.
Placing an Order
To secure your order, the following must be completed:

Confirmation and approval of the final design

Confirmation of a delivery address, or agreement on a specific meeting location, date, and time for pickup

Payment of a 50% non-refundable deposit (subject to cancellation policy below)

Reading and signing of this contract
Orders are not considered placed until all these steps are fulfilled.
Deposit
A 50% deposit of the total order cost (including any applicable delivery fee) is required to place and secure your order. This deposit reserves your date and covers initial materials and preparation.
Cancellation Policy

If you cancel your order at least 7 days (one week) prior to the scheduled delivery or pickup date, a full refund of your 50% deposit will be issued.

If you cancel within 7 days of the delivery or pickup date, no refund of the deposit will be provided, as materials may have already been purchased and preparation begun.
Delivery Fees

Delivery Fee: A flat fee of $20 applies for deliveries within 15 miles of 162 Southern Trace Drive, 30153, Rockmart, GA. For distances beyond 15 miles, an additional $0.50 per mile will be charged (calculated one-way using standard mapping tools).

Meeting at a Spot: If you prefer to meet at a mutually convenient location instead of having the cake delivered to your address, the same delivery fee applies as if I were delivering directly to your home. This means:

A flat fee of $20 applies for meeting spots within 15 miles of my location.

For meeting spots beyond 15 miles, an additional $0.50 per mile will be charged (calculated one-way).

Pickup Option: You may choose to pick up your order directly from my location (162 Southern Trace Drive, 30153, Rockmart, GA). This option is free of charge. If you select this option, a specific date and time must be agreed upon in advance to ensure availability and proper handover.

Finalizing Details: Whether you choose delivery, meeting at a spot, or pickup, all delivery or pickup details must be finalized at the time of order confirmation. This includes the exact address or meeting location, date, and time.
Final Payment
The remaining 50% balance is due the day before delivery or pickup. A photo of the completed product will be sent that day to confirm readiness.

Important Notes:

If payment is not received by the end of the day before delivery, the order will not be delivered or released until payment is completed

This may result in delays or cancellation at my discretion

No product will be handed off without full payment

Changing an Order
Changes to elements of your order (such as design, flavor, size, or other details) may be accommodated after the order is placed, depending on availability and timing. However, requests made close to the delivery or pickup date may not be possible due to preparation constraints. I will notify you promptly if a requested change cannot be made. All changes must be confirmed in writing.
Late to Pickup or Meeting Spot
If you are more than 15 minutes late to the agreed pickup or meeting time without prior notification, the delivery or pickup may need to be rescheduled, and this will be based on my availability. I will make reasonable efforts to contact you, but it is your responsibility to arrive on time or communicate delays.
Responsibility After Delivery or Handover
Once the product is delivered or handed over to you (or your designated representative), it becomes your responsibility. I am not liable for any damage, loss, or issues that occur thereafter, including but not limited to:

Melting due to heat exposure

Structural collapse from improper handling or transport

Accidental drops, tipping, or environmental factors (e.g., humidity, sunlight)
In the event of damage after handover, I cannot guarantee the ability to remake or repair the product due to time and material constraints. If a remake is possible and agreed upon, it will be treated as a new order and charged at full price. No partial or full refunds will be offered for post-handover damage.
Care Instructions
To ensure the best quality and longevity of your product:

Cupcakes must be refrigerated immediately upon receipt. Remove from the fridge no more than one hour before serving to allow them to come to room temperature

Hold cupcake boxes from the bottom for support, not from the sides

Do not stack cupcake boxes on top of each other
-
Carry cupcakes level to prevent shifting or damage
-
Always place cupcakes on a flat, level surface
-
Keep the environment (car or room) as cool as possible during transport and storage
-
Avoid direct sunlight, as it can cause melting
Failure to follow these instructions may result in damage, for which I am not responsible.
Allergy Disclaimer
All products are made in a kitchen that may process common allergens including but not limited to: dairy, eggs, wheat, soy, peanuts, tree nuts, and gluten. While I take precautions to avoid cross-contamination, I cannot guarantee allergen-free products.
It is the customer’s responsibility to inform all guests of potential allergens. If you or your guests have severe allergies, please consult with me before placing your order. I am happy to discuss ingredients and preparation methods, but I do not assume liability for allergic reactions.

Photo Release
By signing this contract, you grant Sugar Crumbs Bakery permission to photograph your custom cupcakes and use the images for promotional purposes, including but not limited to social media, website galleries, and marketing materials.
Photos will not be posted publicly until after your event has concluded, to respect your privacy and preserve any surprises for your guests. No personal information will be shared alongside the images.
Rush Orders
Rush orders are accepted at my discretion and are not guaranteed. If I am unable to accommodate a rush request, I will notify you promptly.
Orders placed less than five days before the desired delivery or pickup time are considered rush orders and may be subject to a rush fee of $25 or more, depending on complexity, availability, and ingredient sourcing.

Custom toppers or specialty ingredients may not be available on short notice

Full payment is required upfront for all rush orders

Rush orders are non-refundable once confirmed, due to the accelerated timeline and immediate material costs
Force Majeure
In the event of circumstances beyond my control (e.g., natural disasters, power outages, illness, or transportation issues), I reserve the right to cancel or reschedule your order.
If I am forced to cancel your order due to such circumstances, you will receive a full refund of any payments made, including your deposit.
If I need to reschedule your order, I will work with you to find a suitable alternative date. If you choose not to reschedule, you will also receive a full refund of any payments made.
Additional Policies

Inability to Fulfill a Request: If, after accepting the order, I determine that a specific element (e.g., a complex design or custom feature) cannot be accomplished as requested due to unforeseen challenges, I will notify you as soon as possible. We can discuss alternatives, such as modifications or substitutions. If no suitable alternative is agreed upon, and the request was a significant part of the order, a partial refund may be issued based on the scope and impact of the change.

Request Feasibility: If a request is not feasible or conflicts with the integrity of the product, I may decline the request before the order is placed to ensure quality and consistency.

Baker's Mishap or Damage: In the rare event that I accidentally damage the product during preparation or prior to delivery/handover, making it unsuitable for sale, I will notify you immediately. I will attempt to remake the product if time allows. If a remake is not possible, I will provide a full refund of any payments made (including deposit).

Minor Cosmetic Imperfections: If minor cosmetic damage occurs during transport or final handling—a shifted decoration, or slight smudging—I will do my best to correct it before delivery or pickup. These imperfections do not affect the quality or taste of the product and are considered acceptable within the scope of handmade goods. A refund or remake will not be offered for minor cosmetic flaws, but I will still make every effort to fix or improve the appearance before handoff.
